Sometimes the New Moon sets before sunset or after sunset or with sunset. Which one of these would be valid for deeming the next day as the first of the month?

The New Moon cannot be seen usually before sunset, since the light of the sun prevents its sighting, and if it is seen after sunset it proves that the next day is the first day of the month.

It is valid if it was via telephone or similar live voice communication, and not valid if it was via chat or email.
